Terms of Use

1. Acceptance of Terms

By accessing or using faivv.com ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

2. Description of Service

Faivv is an addressless messaging platform that allows registered users to create content segments (text, columns, or files), assign a key-phrase, and optionally set a time-to-live (TTL). Anyone with the key-phrase can view the content until it expires or is withdrawn. The Service also includes an AI News Scheduler that automatically generates reflective content from publicly available news articles using large language models. AI-generated content is clearly labelled and published under fictitious creator identities for trial purposes.

3. User Accounts

You must create an account to publish or manage content. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must be at least 13 years of age to use the Service.

4. User Content

You retain ownership of content you create. By publishing content on the Service, you grant Faivv a limited, non-exclusive licence to host, display, and deliver your content to viewers who hold the corresponding key-phrase. You are solely responsible for the content you publish.

5. AI-Generated Content

Certain content on the Service is generated by artificial intelligence systems operated by Faivv. This content is created by transforming publicly available news articles into reflective commentary using large language models. AI-generated content is published under fictitious creator identities and is clearly marked with an "AI-generated" label so you can distinguish it from human-created content. Faivv operates and labels these systems, but AI-generated content is produced automatically, may not have been reviewed by a human, may contain inaccuracies or fabrications ("hallucinations"), and is provided without any warranty of accuracy, reliability, or completeness. AI-generated content does not represent human opinion and should not be relied upon as a primary source of information or as professional, medical, legal, or financial advice. You should independently verify any information before relying on it. See our Disclaimer for further limitations of AI-generated content.

6. Prohibited Use

You agree not to:

• Publish content that is unlawful, defamatory, obscene, or infringes any third-party rights;
• Use the Service to distribute spam, malware, or phishing material;
• Attempt to gain unauthorised access to any part of the Service, other accounts, or computer systems;
• Use automated tools to scrape, collect, or abuse content from the Service without prior written consent.

7. Key-Phrases and TTL

A key-phrase is a user-defined or auto-generated code that grants access to a published Faivv. Key-phrases are not encrypted passwords — treat them as shared secrets. Content with a TTL is automatically and permanently deleted after the TTL period expires. Faivv cannot recover expired content.

8. Third-Party Services

The Service relies on third-party providers including Google Firebase (authentication, database, and file storage) and third-party large language model providers (for AI content generation). Your use of the Service is also subject to those providers' terms of service. We are not responsible for the acts, omissions, or service interruptions of third-party providers.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, Faivv Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the Service.

In any event, our aggregate liability shall not exceed the greater of HKD 100 or the total amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify Faivv Limited and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the Service, your violation of these Terms, or any content you publish.

12. Termination

We reserve the right to suspend or terminate your access at any time, with or without notice, for conduct that violates these Terms or is harmful to others. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. You agree to submit to the exclusive jurisdiction of the courts of Hong Kong.

The Service is operated from Hong Kong and is not specifically directed at users in any particular foreign jurisdiction. If you choose to access the Service from outside Hong Kong, you do so on your own initiative and are responsible for compliance with any applicable local laws.

14. Changes to Terms

We may revise these Terms at any time by posting updated Terms at faivv.com/terms with a revised effective date. If a change is material, we will provide reasonable notice through the Service where required by law. Continued use of the Service after revised Terms are posted constitutes your acceptance of the changes. It is your responsibility to review these Terms periodically.
